Terms of Service

These terms govern your use of Zuvio Atlas. By creating an account or installing the agent, you agree to them.

1. The agreement

These Terms are between you (or the organisation you represent) and Zuvio Systems, of Nairobi, Kenya, operator of Zuvio Atlas. If you accept these Terms on behalf of a company, you confirm you have authority to bind it.

Our Privacy Policy forms part of these Terms.

2. The service

Atlas is a server monitoring and observability platform. It collects metrics from an agent you install, probes endpoints you nominate, evaluates alert rules, and notifies you when something looks wrong.

Atlas is a monitoring tool, not a guarantee of uptime. It observes your systems; it does not operate, protect, or repair them. You remain solely responsible for your own infrastructure, backups, and incident response.

3. Your account

  • You must provide accurate information and keep your sign-in credentials secure.
  • You are responsible for everything done under your account, including by team members you invite.
  • You must be at least 18 years old.
  • Agent tokens grant the ability to submit telemetry to your account. Treat them as secrets. If one leaks, rotate it from the dashboard immediately.
  • Tell us promptly if you suspect unauthorised access.

4. Acceptable use

You may monitor only infrastructure you own or are authorised to monitor. You must not:

  • point uptime, synthetic, SNMP, or port checks at systems you do not control or have permission to probe;
  • use Atlas to conduct port scanning, reconnaissance, denial-of-service, or any attack against a third party;
  • configure check frequencies or synthetic transactions intended to load or disrupt a target;
  • resell or provide the service to third parties except as permitted under a plan that includes client management;
  • attempt to breach tenant isolation, access another customer's data, or circumvent plan limits;
  • reverse engineer the service, except where that right cannot lawfully be excluded;
  • upload unlawful content, or use Atlas in violation of any applicable law or sanctions regime.

Abuse of the probe network is the fastest way to lose your account. We may suspend immediately, without notice, where we believe use is harming a third party or our infrastructure.

5. Your data

You retain all rights to the telemetry and configuration you send us. You grant us only the licence necessary to store, process, and display it in order to provide the service.

You confirm you have the right to send us the data your agents report, including where it may incidentally contain personal data of your own staff or users.

We may use aggregated, anonymised statistics that cannot identify you or your infrastructure to improve the service.

6. Plans, billing, and refunds

  • Paid plans are billed in advance, monthly or annually, through our payment processor.
  • Subscriptions renew automatically until cancelled.
  • You can cancel at any time. Cancellation takes effect at the end of the current billing period; we do not pro-rate partial periods.
  • Fees are non-refundable except where required by law, or at our discretion.
  • Plan limits — servers, checks, team members, and message allowances — are enforced on creation. Exceeding a limit blocks new resources; it does not delete existing ones.
  • SMS and voice allowances are pooled across your organisation and reset each calendar month. Unused allowance does not carry over.
  • We may change pricing with at least 30 days' notice to account owners. Changes take effect at your next renewal.
  • If payment fails, we may downgrade or suspend the account after a reasonable grace period.

7. Free tier

The free tier is provided as-is, with reduced limits, shorter history, and no service commitment. We may change or withdraw it at any time. Free accounts that show no activity for an extended period may be deleted after notice to the registered email address.

8. Availability and alert delivery

This is the most important limitation in these Terms, so it is stated plainly.

Atlas is provided on a commercially reasonable efforts basis. We do not guarantee that the service will be uninterrupted, that every check will run on schedule, or that every alert will be delivered.

Alerts depend on networks and third parties outside our control — email providers, SMS and voice carriers, chat platforms, and the reachability of your own systems. Notifications may be delayed, duplicated, or lost.

Do not rely on Atlas as the sole safeguard for a system where failure would cause serious harm or loss. Maintain independent monitoring and escalation for anything critical.

We may perform maintenance that briefly interrupts the service, and will give advance notice where practical.

9. Disclaimer of warranties

To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory — including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

Our total aggregate liability arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or USD 100.

In particular, we are not liable for losses arising from an undetected outage, a missed or delayed alert, or a false alert. Nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Indemnity

You agree to indemnify Zuvio Systems against claims, damages, and costs arising from your use of the service in breach of these Terms — in particular, claims from a third party whose systems you monitored or probed without authorisation.

12. Suspension and termination

You may terminate at any time by deleting your account from the dashboard. Deletion is permanent and removes your data as described in the Privacy Policy.

We may suspend or terminate an account that breaches these Terms, that we are legally required to act against, or whose use threatens the integrity of the service. Where circumstances allow, we will give notice and an opportunity to fix the problem.

On termination, your right to use the service ends immediately and your data is deleted after a short grace period.

13. Changes to these terms

We may update these Terms. For material changes we will update the effective date and notify account owners by email before they take effect. Continued use after that constitutes acceptance. If you disagree, stop using the service and cancel.

14. Governing law

These Terms are governed by the laws of Kenya, and the courts of Nairobi have exclusive jurisdiction, without regard to conflict-of-law rules. This does not deprive you of the protection of mandatory consumer law in your country of residence.

15. General

These Terms and the Privacy Policy are the entire agreement between us. If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets.
